Suspect in shooting incident appears in court

By Lisa Young
Staff writer

Sterling man Dillon Alan Tadolini, 24, appeared in handcuffs before Judge Michael K. Singer in Logan County District Court Thursday, Aug. 17, for a status conference on three criminal cases.

Defense lawyer Oleh Sniezko requested one disposition hearing on all three cases be granted. While he reserved his right to preliminary hearing, he waived the 35-day rule that requires the court to set such a hearing within 35 days of a request. The court set a disposition hearing for Oct. 13 at 1:30 p.m.

One of the criminal cases against Tadolini stems from an incident on July 9 in which he allegedly shot at Sterling police officers following a foot chase near Cleveland and Franklin streets. Tadolini was later apprehended in the 400 block of Jackson Street.

Officers responding to the incident said in a police press release that they heard “what sounded like two gunshots coming from the proximity of the running male.” Officers did recover a firearm on the suspect, but declined to give any further details.

Tadolini is being held on several charges in connection with the July 9 incident, including attempted first degree murder, felony menacing, and possession of weapons by a previous offender, obstructing a peace officer, and second degree criminal trespass.

At the time of his arrest, Tadolini was also wanted for previous charges including aggravated robbery, second-degree assault, felony menacing, possession of weapons by a previous offender, violation of a protection order and harassment.

Sterling man’s suspicious death confirmed a homicide

By Sara Waite

It’s been over three months since 34-year-old Alexis Cano was found dead in his Sterling home under suspicious circumstances.

And just recently, his family finally got the official word that the father of three was murdered.

Brittney Moya, Cano’s ex-wife, said the family recently received Cano’s death certificate, which lists his manner of death as a homicide.

According to Sterling Police Chief Tyson Kerr, the case has always been investigated as a homicide, although officials would not confirm that when the news was first reported in May. Kerr characterized the investigation as “very active,” and said the SPD is working with the District Attorney’s office.

Kerr could not release much in the way of details about the investigation, but said it is a top priority for the department. He added that the family has been kept up to date as much as possible without jeopardizing the integrity of the investigation. He did reaffirm that Cano’s murder is not being considered a random crime, meaning that there is no overt public safety issue.

Kerr said he hoped to have more news to release in the near future.

Cano’s body was discovered Friday, May 12, in his home in the 500 block of Jackson Street.

He was survived by three children, ages 5, 8 and 12.

“It’s really upsetting that somebody took away the chance for him and his kids to have a relationship,” Moya said.

Moya has helped the family create a Justice for Lex page on Facebook for loved ones to share remembrances and keep up to date on the case. The family is also planning a candlelight vigil on Sept. 30 to celebrate Cano’s birthday; the event will be held at 6 p.m. at the Fort Morgan Public Library.

At the time of his death, Cano had recently completed his GED at Northeastern Junior College; classmates recognized him during the GED graduation ceremony in June.

Mistrial leads to plea deal in stabbing

By Lisa Young
Staff writer

Gilbert San Miguel of Sterling waived his chance at a new jury trial after a jury in August failed to reach a verdict on the felony assault case against him, entering a plea on a lesser charge instead.

San Miguel stood trial in Logan County District Court this past August, facing felony charges after being accused of attacking a Sterling man with a knife during an altercation in 2016.

He was arrested nearly a year ago on Nov. 9, 2016, and charged with first degree assault, menacing and possession of an illegal weapon, after investigators linked him to an incident that took place in the 1100 block of N. Eight Street during the late night hours of Nov. 8, 2016.

Skyler Fischer, the alleged victim, was taken to Sterling Regional MedCenter the night of the altercation with several non-life threatening stab wounds. Fischer was later released from the hospital. San Miguel failed to report the incident to Sterling police and was taken into custody.

According to Assistant District Attorney Travis Sides, San Miguel took a plea deal in which he voluntarily pleaded guilty to a lesser charge of third degree assault in the matter. Sides said San Miguel will now serve an 11-month jail sentence.

San Miguel had the option of a new jury trial after District Judge Michael Singer was forced to declare a mistrial in August when the 12-person jury failed to reach a unanimous verdict. San Miguel’s defense was that the stabbing happened in self-defense. Sides had argued that San Miguel willingly and knowingly attacked Skyler Fischer with a deadly weapon, causing serious bodily harm.

Because of the hung jury, San Miguel was given the option of a new trial within 90 days or the opportunity to reach a plea agreement with the District Attorney’s office.
